HAVEN PLUS — PROPERTY CARE SERVICE AGREEMENT

This Agreement is between Haven Plus (ABN 83 695 213 499) and the Subscriber identified below.

1. Definitions

"Agreement" means this Haven Plus Property Care Service Agreement, including all Schedules.

"Subscriber" means the individual or entity that enters into this Agreement with Haven Plus.

"Property" means each residential property registered by the Subscriber under a Subscription Plan.

"Subscription Plan" means the Essential, Smart, or Premium plan selected by the Subscriber, as described in Clause 2.

"Subscription Visit" means a scheduled attendance at the Property for cleaning, inspection, or preventive maintenance as specified in the Subscription Plan.

"Cleaning Hours" means the hours of on-site cleaning labour included in a Subscription Plan, delivered across Subscription Visits throughout the subscription year.

"Service Hour" or "SH" means one (1) hour of on-site labour for handyman, maintenance, gutter cleaning, or non-emergency repair work, excluding licensed electrical, plumbing, or gas-fitting trades.

"SH Voucher" means the Service Hours included as a complimentary benefit of a Subscription Plan at no additional charge, issued annually.

"SH Bundle" means a prepaid package of Service Hours purchased separately from a Subscription Plan.

"Service Report" or "SR" means the record generated after every visit, documenting the work performed, before and after photographs, time spent, and any Service Hours deducted.

"Maintenance Checkup Report" or "MCR" means the property condition checklist completed during each Subscription Visit, recording the observable state of key maintenance items and any recommended follow-up actions. An MCR is not a building inspection, structural assessment, or compliance certificate.

"Service Zone" means the area within thirty (30) kilometres of the designated Haven Plus operational base in Perth, Western Australia.

2. Subscription Plans & Inclusions

Haven Plus offers three Subscription Plans. Each plan is applied per Property and is based on a twelve (12) month commitment.

All prices stated in this Agreement are inclusive of GST where applicable.

Each plan includes total annual cleaning hours. The default visit intervals and cleaning duration are provided as a guide; actual frequency and duration may be adjusted by mutual agreement, provided the total annual cleaning hours are maintained.

Smoke Alarm Service includes visual inspection and battery replacement only. Smoke alarm installation, replacement, or any work involving electrical wiring must be performed by a licensed electrician and is not included in the Subscription Plan.

Unused cleaning hours carry over to the next subscription year (max one year). Upon cancellation, unused cleaning hours are not refundable.

Haven Plus may adjust pricing with thirty (30) days' written notice. For monthly subscribers, adjusted pricing takes effect from the next billing cycle. For annual subscribers, adjusted pricing takes effect from the next annual renewal date. If the Subscriber does not wish to accept the new pricing, they may cancel and the standard cancellation and settlement terms under Clause 6.4 apply based on the original pricing.

3. Service Hours (SH)

3.1 SH Vouchers (Plan Benefit)

SH Vouchers are complimentary, issued annually on the subscription anniversary. Unused vouchers expire after 12 months. Not transferable or refundable. Upon cancellation, unused vouchers expire immediately.

3.2 SH Bundles (Standalone Purchase)

SH Bundles are available for purchase independently of a Subscription Plan:

Refundable upon written request. Used hours settled at $99/SH regardless of bundle purchased. Remaining balance refunded.

3.3 SH Deduction Rules

Haven Plus provides an estimated SH deduction for approval via the dashboard before commencing work. Deductions are based on actual on-site time, rounded to 0.25 SH (minimum 0.5 SH per job). Properties outside the Service Zone incur 0.5 SH travel surcharge.

Service Hours cover labour only. Materials are charged separately at cost with prior approval. Haven Plus will provide an itemised estimate of material costs together with the SH estimate.

3.4 Scope & Exclusions

Service Hours cover general handyman, maintenance, gutter cleaning, and non-emergency repair work only. Depending on the nature of the work, Haven Plus may assign a licensed technician where required. Work requiring a licensed technician may attract an additional SH surcharge, disclosed at the time of the SH estimate approval.

The following are excluded from the standard SH scope: licensed electrical work (other than replacement of bayonet or screw-fit light globes); licensed plumbing work (other than clearing minor blockages with a plunger); gas fitting, roofing, structural, or asbestos-related work; tree lopping requiring specialist equipment or certification; replacement of light fittings, power points, or any fixed wiring.

Where Haven Plus has a licensed technician available, licensed work may be performed within the SH system at the Subscriber's request, with an applicable surcharge disclosed at the time of the SH estimate approval.

Haven Plus does not undertake home building work as defined under the Home Building Contracts Act 1991 (WA). For larger-scale projects, Haven Plus has licensed carpenters available and can provide a separate quotation. Such projects are governed by a separate agreement.

4. Billing, Payment & Payment Failure

4.1 Billing Cycle

Subscriptions are billed monthly or annually in advance via Stripe on the subscription anniversary date.

4.2 Payment Failure Process

The Subscriber may update their payment method at any time via the dashboard.

If a payment failure is caused by a processor or banking system error, Haven Plus will not suspend services until the Subscriber has been notified and given a reasonable opportunity to resolve the issue.

4.3 Hardship Provision

Contact Haven Plus in writing for alternative arrangements during genuine financial hardship.

5. Plan Upgrades & Downgrades

Upgrades: Available anytime via dashboard. New plan starts a fresh 12-month cycle. Excess usage from old plan is carried over. For monthly subscribers, hours paid for are based on months elapsed; annual subscribers' hours are fully paid from day one. This applies independently to both Cleaning Hours and Service Hours.

Downgrades: Request in writing. Takes effect at the next billing cycle.

6. Contract Term, Cancellation & Settlement

6.1 Term & Renewal

12-month commitment, auto-renewing monthly thereafter. Price adjustments governed by Clause 2; other terms changes governed by Clause 15.

6.2 Cooling-Off

Cancel within 30 days with no early termination fee and a full refund, provided no services have been performed. Once any service has been delivered, the cooling-off right expires and Clause 6.4 applies.

6.3 Cancellation & Settlement

Cancel anytime. Settlement: (a) elapsed fees non-refundable, prepaid future fees refunded; (b) SH Vouchers expire; (c) purchased SH settled at $99/SH; (d) early termination fee:

Total payable shall not exceed total fees paid to date. 50% hardship reduction available. Transfer on property sale: fee waived ($50 transfer fee).

6.4 Other Cancellation

Haven Plus may cancel with 30 days' notice for material breach. Subscriber may cancel immediately if Haven Plus fails to deliver the agreed cleaning hours for 2+ consecutive visit periods. Pro-rata refunds apply if services discontinued.

7. Scheduling & Property Access

Set preferences via dashboard. 48 hours' notice to reschedule free. No-access: for a Subscription Visit, 1 cleaning hour is deducted from the annual allocation; for a Service Hour job, 1 SH is deducted. One replacement visit offered where practicable (additional 0.5 SH). 3 consecutive no-access: plan suspended for that property.

8. Reports

Service Report (SR) after every visit; Maintenance Checkup Report (MCR) during each Subscription Visit. Visible conditions only. Available on dashboard as PDF. Retained 24 months.

9. Multi-Property

Each property needs its own plan. SH Vouchers are per-property; purchased SH Bundles apply across all properties.

10. Liability & Insurance

Haven Plus will maintain public liability insurance of at least $10M prior to commencing services. Single claim limited to the greater of 3 months' fees or SH consumed. Does not limit Australian Consumer Law rights.

11. Australian Consumer Law

Nothing in this Agreement excludes rights under the Australian Consumer Law. Haven Plus complies with unfair contract terms provisions.

12. Privacy

Handled per Australian Privacy Act 1988. Property data not shared without consent. Where the Property is tenanted, the Subscriber is responsible for ensuring necessary consents under the Residential Tenancies Act 1987 (WA). Contact: hello@havenpluscare.com

13. Force Majeure

Neither party liable for events beyond reasonable control.

14. Dispute Resolution

Write to hello@havenpluscare.com first. Response within 5 business days. If unresolved in 14 days, mediation in Western Australia.

15. General

Entire Agreement: Constitutes the entire agreement between the parties.

Amendment: Haven Plus may amend non-pricing terms with 30 days' notice. Subscriber may cancel under Clause 6.4 if they do not accept. Pricing adjustments governed exclusively by Clause 2.

Governing Law: Laws of Western Australia apply.

Execution

By activating a Subscription Plan, the Subscriber agrees to all terms of this Agreement.
